1. Agreement to Terms

By accessing or using barrto.com (the "Service") operated by Pear LTD ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

barrto.com provides AI-powered image transformation services. Users can upload images and provide text prompts to generate transformed versions of their images. The Service includes both free features (background removal) and paid features (AI transformations).

3. Eligibility

You must be at least 16 years of age to use our Service. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms.

4. User Responsibilities

When using our Service, you agree to:

• Provide accurate and complete information, including a valid email address
• Use the Service only for lawful purposes
• Not upload images that you do not have the right to use or transform
• Not use the Service to create illegal, harmful, offensive, or inappropriate content
• Not attempt to circumvent any security measures or restrictions
• Not use the Service to infringe on the intellectual property rights of others

5. Prohibited Content

You may not use our Service to create or process:

• Illegal content or content promoting illegal activities
• Sexually explicit content involving minors
• Content that promotes violence, hatred, or discrimination
• Content that infringes on intellectual property rights
• Fraudulent or deceptive content
• Content that violates the privacy of others

We reserve the right to refuse service and terminate accounts that violate these restrictions.

6. Pricing and Payment

Pricing: AI image transformations are priced at €2 (or $2) per transformation, which includes 3 AI-generated variations. Free background removal is available at no cost.

Payment Methods: We accept payments via Stripe (credit/debit cards) and PayPal.

Currency: Prices are displayed in EUR or USD based on your selection. All payments are final once processed.

7. Refund Policy

We want you to be satisfied with our Service. Refunds may be issued under the following conditions:

• The generated images are significantly different from what was reasonably expected based on your prompt
• Technical errors prevented successful delivery of your images
• The Service failed to process your request

Refunds are not available for dissatisfaction due to subjective aesthetic preferences when the AI has reasonably interpreted your prompt.

8. Intellectual Property

Your Content: You retain all ownership rights to the images you upload. By using our Service, you grant us a limited license to process your images solely for the purpose of providing the Service.

Generated Content: You own the rights to the transformed images generated from your original content. You may use them for personal or commercial purposes.

Our Content: The barrto.com website, branding, and underlying technology are owned by Pear LTD and protected by intellectual property laws.

9. Service Availability

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from Service interruptions.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will meet your specific requirements, that results will be accurate or reliable, or that the Service will be error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Pear LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Third-Party Services

Our Service relies on third-party providers including Fal AI for image processing, Stripe and PayPal for payments, and Vercel for hosting. Your use of these services is subject to their respective terms and policies. We are not responsible for the actions or policies of these third parties.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

14. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Latvia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Latvia.
